The Private Economy Promotion Law sets many "firsts"

On April 30, 2025, the 15th meeting of the Standing Committee of the 14th National People's Congress voted to pass the "Private Economy Promotion Law of the People's Republic of China", which will be officially implemented on May 20.

The Law on Promotion of Private Economy has made many "firsts" . For example, the first time it will be written into the law, the first time it will clarify the legal status of the private economy, and the first time it stipulates that promoting the sustained, healthy and high-quality development of the private economy is a major policy that the country has adhered to for a long time. This fully demonstrates the firm determination of the Party Central Committee to promote the development and growth of the private economy, and further demonstrates to the society that the development of the private economy is a policy that the Party and the country have consistently adhered to for a long time.

Private enterprises won bids for projects below 100 million yuan more than 80%

From January to April this year, the winning rate of private enterprise projects increased by 5 percentage points year-on-year. For projects under 100 million yuan, the number of private enterprises won bids exceeds 80%. Zheng Bei, deputy director of the National Development and Reform Commission, introduced that in the next step, when private enterprises encounter access barriers, they can log in to the National Development and Reform Commission portal to report the relevant column on the construction of a national unified market. Regarding relevant clues, the National Development and Reform Commission will work with relevant parties to carefully and promptly verify and deal with them.

Support private enterprises to actively participate in the construction of the "two-fold" and the "two-new" work, and are accelerating the improvement of a long-term mechanism for private enterprises to participate in the construction of major national projects. A number of major projects have been launched in the fields of nuclear power, railways, etc. At present, the private capital shareholding ratio of some nuclear power projects has reached 20%, and the funds supported by private enterprises in the fields of industrial equipment renewal, recycling and utilization account for more than 80%. This year, high -quality projects with a total investment scale of about 3 trillion yuan will be launched in key areas such as transportation, energy, water conservancy, new infrastructure, and urban infrastructure .

■ Improve financial service models in high-tech and emerging industries

In the fields of high-tech and emerging industries where private enterprises have performed well in recent years, the State Administration for Financial Supervision and Administration has focused on improving the technology and financial service model.

At present, 74 private equity investment funds have been established, and merger and acquisition loans for technology enterprises have been implemented in 18 pilot cities to support technology enterprises to smooth the capital circulation.

Innovate ways to increase credit . Promote the construction of an intellectual property financial ecological comprehensive pilot zone, optimize relevant policies such as registration, evaluation, disposal, and compensation of intellectual property rights, and assist in intellectual property pledge financing. Jointly issued a guarantee plan to support science and technology innovation with the financial department to provide special guarantees for loans to small and medium-sized enterprises such as science and technology, high-tech, and specialized and innovative. By the end of the first quarter of this year, the national loan balance of high-tech enterprises was 17.7 trillion yuan, an increase of 20% year-on-year.

To support the transformation of scientific and technological achievements, two insurance compensation pilot projects have been carried out for the first batch of major technical equipment and key new materials . At present, the cumulative risk protection has been provided exceeding one trillion yuan.

In the small and micro financing coordination mechanism, the foreign trade sector is listed separately, the list of foreign trade enterprises is comprehensively sorted out, and priority is given to visiting and matching financing.

The amount of short-term export credit insurance to support export trade has exceeded US$240 billion in the first quarter of this year. In some industries that play an important supporting role in the foreign trade market, such as electronic information, modern chemical industry, complete vehicle engineering machinery, etc., the insured amount has increased significantly.

Innovate the "cross-border e-commerce insurance" model, support new foreign trade formats, guide insurance companies to develop exclusive guarantee insurance products, and provide credit guarantee for domestic procurement of cross-border e-commerce.

Increase credit allocation in wholesale and retail, accommodation and catering, cultural tourism, education and training, healthy elderly care and other fields, and support the healthy development of private enterprises in the consumer service industry.

■ Form a list of key private investment projects

The State Administration for Financial Supervision and Administration has cooperated with the National Development and Reform Commission to establish a special working mechanism for financing docking, formed a list of key private investment projects , and pushed it to banks to guide banks to independently connect with financing services.

Some places also have good practices and explorations. For example, some places have built special online docking platforms. Banks can obtain project information through the platform, use big data technology, accurately identify projects that match credit policies , and realize the transformation from "project search funds" to "fund search projects", effectively improving docking efficiency.
